Forest Rights Act, 2006
Scheduled Tribes & Other Traditional Forest Dwellers (RoFR) Act, 2006 was notified by the Govt. of India on 2nd January, 2007. Scheduled Tribes & Other Traditional Forest Dwellers (RoFR) Rules, 2007 was notified in the Gazette of India on 1st January, 2008. As per provision of the Forest Rights Act, Tribal Welfare Department is the Nodal Department for implementation of the various provisions of the Forest Rights Act. 2006.
For smooth and effective implementation of the provisions of the SOTFD (RoFR) Act, 2006 and SOTFD (RoFR) Rules, 2007, the following committees had been constituted:
- Forest Rights Committees for all Gram Panchayat and Village Committees under Tripura Tribal Area Autonomous District Council.
- State Level Committee ( SLC) on Forest Rights Act , 2006 and Chief Secretary is the Chairman of the committee.
- District Level Committee ( DLC) on Forest Rights Act, 2006 for all Districts.
- Sub-Divisional Level Committee on Forest Rights Act, 2006 for all Sub-Divisions.
Salient features of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act,2006.
- Right to hold and live in the forest land under the individual or common occupation for habitation or self-cultivation for livelihood by a member or members of a forest dwelling Scheduled Tribe or other traditional forest dweller.
- Right of ownership, access to collect, use, and dispose of minor forest produce which has been traditionally collected within or outside village boundaries.
- Other community rights of uses or entitlements such as fish and other products of water bodies, grazing and traditional seasonal resource access of nomadic or pastoralist communities.
- Rights including community tenures of habitat and habitation for primitive tribal groups and pre- agricultural communities
- Rights for conversion of pattas or leases or grants issued by any local authority or any State Govt. on forest lands to titles.
- Rights to protect, regenerate or conserve or manage any community forest resource which they have been traditionally protecting and conserving for sustainable use.
- Right of access to bio diversity and community right to intellectual property and traditional knowledge related to bio diversity. Etc
